1. Who you contract with

Kennelbook ("the Service") is operated by Goldgame ("we", "us", "Goldgame"). By creating an account or using the Service you enter into an agreement with Goldgame. If you use the Service on behalf of a kennel, business or organisation, you confirm that you have authority to bind it; if you use it as an individual, you confirm you are of legal age in your country.

2. Acceptance

By registering for, accessing or continuing to use the Service you agree to these terms. If you do not agree, please stop using the Service. We may update these terms; continued use after an update means you accept the updated version.

3. What the Service does

Kennelbook is a web platform for dog breeders to keep dog and litter records, health and show results, growth measurements, pedigree data and pedigree designs, to plan breedings with inbreeding calculations, to publish public kennel, dog and litter pages, and to keep puppy buyers updated. Pedigree calculations and any other output are informational aids and do not replace your own professional or veterinary judgement.

4. Your account

You must give accurate registration information and keep it up to date. You are responsible for keeping your login credentials confidential and for all activity under your account. Tell us immediately if you suspect unauthorised use.

5. Acceptable use

You must not misuse the Service. In particular, you must not:

• use the Service for any unlawful purpose or in breach of animal welfare law;
• commit fraud, send spam, or publish misleading pedigree, health or show information;
• upload content that infringes anyone's intellectual property, privacy or other rights;
• interfere with the security or integrity of the Service, including uploading malware, probing or scanning our systems, bypassing technical limits, or scraping data;
• reverse engineer, resell or redistribute the Service or any part of it.

6. Your content

You keep ownership of the photos, records and other content you upload. You grant Goldgame a limited, non-exclusive licence to host, store, process and display that content solely to operate and provide the Service, including on the public pages you choose to publish. You confirm you have the rights needed for everything you upload. If a rights-holder believes content on the Service infringes their rights, they can contact us and we will review it; we may remove content and may suspend accounts that repeatedly infringe.

7. Our intellectual property and your licence

Goldgame retains all ownership and intellectual property rights in the Service, its software, design, pedigree layouts, documentation and branding. We grant you a limited, non-exclusive, non-transferable right to use the Service within the plan you have selected.

8. Plans and payment

Kennelbook has a free plan and a Premium membership at $59 per month. New members receive a free first week of Premium features. Payment, billing, currency, tax, invoicing, subscription renewal, cancellation and refund mechanics are handled by our reseller and are governed by the Paddle Checkout Buyer Terms. Our own refund commitment is described in our Refund Policy.

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.

9. Service level

We work to keep the Service available and accurate, but we do not guarantee that it will be uninterrupted, error-free or free of data loss. To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability and fitness for a particular purpose.

10. Suspension and termination

We may suspend or terminate your access for material breach of these terms, non-payment, security or fraud risk, or repeated or serious policy violations. You may stop using the Service and cancel your membership at any time. When access ends you will have a reasonable window to export your records before data is deleted.

11. Liability

To the extent permitted by law, our aggregate liability arising out of or relating to the Service is limited to the fees you paid in the 12 months before the claim. We exclude liability for indirect, consequential or special damages, including loss of profits, data, breeding opportunities or goodwill. Nothing in these terms excludes liability for fraud, death or personal injury caused by negligence, or any other liability that cannot be excluded by law. You agree to indemnify us against claims arising from your content, your unlawful use of the Service, or your breach of these terms.

12. General

You may not assign your rights under these terms without our consent; we may assign them as part of a merger, acquisition or reorganisation. Neither party is liable for delays caused by events beyond its reasonable control. These terms are governed by the laws of the jurisdiction in which Goldgame is established, and disputes will be heard by the courts of that jurisdiction.
